Attorney General Steve Marshall Announces Arrest of Former Trussville Police Officer for Custodial Sexual Misconduct
(MONTGOMERY) – Attorney General Steve Marshall announced the arrest today of a former Trussville police officer for custodial sexual misconduct. David Wayne Montgomery, 51, of Orange Beach, surrendered late yesterday to the Jefferson County Sheriff’s Office and was taken to the Jefferson County Jail. He was released on a bond of $15,000.
Attorney General Marshall’s Criminal Trials Division presented evidence to a Jefferson County grand jury, resulting in Montgomery’s indictment* on February 23. Specifically, the indictment charges him with one count of custodial sexual misconduct by engaging in sexual conduct with a female inmate in the custody of the Trussville City Jail.
No further information about the investigation or about Montgomery’s alleged crimes other than that stated in the indictment may be released at this time.
If convicted, Montgomery faces a maximum penalty of up to 10 years imprisonment and a fine of up to $15,000 for custodial sexual misconduct, a class C felony.
*An indictment is merely an accusation. The defendant is presumed innocent unless and until proven guilty.
