AG MARSHALL LEADS 11-STATE COALITION OPPOSING
LIBERAL AGS’ EFFORT TO INJECT FIREARMS REGULATION
INTO GUN MANUFACTURER CLASS ACTION SETTLEMENT
(MONTGOMERY) – Alabama Attorney General Steve Marshall led 11 states in filing an
amicus brief in federal court Monday opposing efforts by Massachusetts and other
states to introduce firearms regulation into a class action settlement that compensates
gun owners for purchases of weapons that may have had defective triggers.
The lawsuit and settlement covered only the economic issue of compensation to
consumers who may have received a defective product from the Remington Arms
Company. However, Massachusetts and other states are attempting to inject matters of
public safety and gun policy which simply are not at issue in the case. The case, Pollard
v. Frost and Denney, is being appealed to the U.S. Court of Appeals for Eight Circuit.
“This lawsuit is a dispute between private parties about economic losses that the
plaintiffs allegedly incurred when they bought an allegedly defective product from the
defendant,” the Attorneys General state in Monday’s amicus brief. “The mere fact that
the product at issue is a gun does not transform this case into a lawsuit about firearm
safetyÖ.Because the settlement adequately addresses that alleged economic loss,
Massachusetts’s public safety concerns should not become an obstacle” to the
finalization of the settlement.
Joining Alabama in the amicus brief are Arkansas, Louisiana, Michigan, Missouri,
Nebraska, South Carolina, South Dakota, Utah, West Virginia and Wisconsin.
