AG MARSHALL ANNOUNCES CONVICTION FOR THEFT
RELATED TO WORKERS’ COMPENSATION; BALDWIN
COUNTY MAN ORDERED TO PAY $211,243 IN RESTITUTION
(MONTGOMERY) – Attorney General Steve Marshall today announced the
conviction of a Baldwin County man who was ordered to pay $211,243 in restitution for
a theft related to workers’ compensation. Kelvin Leon Farrington, of Gulf Shores,
pleaded guilty yesterday in Baldwin County Circuit Court to first-degree theft. In
addition to the restitution order, he was sentenced to two years, which was suspended,
and placed on probation for three years.
Farrington’s conviction arises from reimbursement claims he made for travels to
health care providers who were treating an injury for which he had been receiving
workers’ compensation benefits for a number of years. Farrington overstated his actual
mileage by exorbitant amounts, and the overpayments were a theft from the insurance
company that covered his workers’ compensation, which paid a far greater amount
than Farrington was entitled to receive.
“Theft related to workers’ compensation actually involves many victims,” said
Attorney General Marshall. “This is not just a crime against the private companies that
insure and pay out the benefits, but also against the State of Alabama and those workers
who make honest claims for which they are legitimately deserving of assistance. I am
pleased that this defendant is being held to account for his theft and we are recovering
the resources that were lost due to his deception.”
Attorney General Marshall thanked the Alabama Labor Department, which
referred this matter to the Attorney General’s Office for investigation and possible
prosecution. He commended those involved in bringing the case to a successful
conclusion, noting in particular Assistant Attorneys General Brittney Bucak and
Christopher Moore of his Criminal Trials Division and Special Agents of his
Investigations Division.
