AG ANNOUNCES INDICTMENT OF PELL CITY WOMAN
CHARGED WITH ASSAULTING NURSING HOME RESIDENT
(MONTGOMERY)–Attorney General Luther Strange today announced the
indictment of a former nursing aide who is charged with assaulting a resident of
a nursing home in Pell City. Aisha L. Embery, 34, of Pell City, was arrested
yesterday by the St. Clair County Sheriff’s Office, and has been released on bond.
The Attorney General’s Medicaid Fraud Control Unit presented evidence
to a St. Clair County grand jury, resulting in Embery’s indictment* on August 4.
Embery is charged with assaulting a resident of Golden Living Center while she
was employed as a certified nursing assistant at the nursing home.
Specifically, Embery was indicted for Abuse of a Protected Person, and is
accused of striking the resident in the face while providing care to the resident
on December 6, 2010. Embery was immediately terminated, and the facility
reported the incident to authorities. This crime is a class C felony punishable by
one to ten years imprisonment and a fine of up to $15,000.
No further information about the investigation or about Embery’s alleged
crime other than that stated in the indictment may be released at this time.
The Attorney General’s Medicaid Fraud Control Unit prosecutes cases of
abuse, neglect and exploitation covered by the Adult Protective Services Act that
occur in facilities that receive Medicaid funding, as well as handling cases of
Medicaid fraud. This case was investigated by the Attorney General’s Medicaid
Fraud Control Unit and is being prosecuted by the Unit’s director, Assistant
Attorney General Bruce Lieberman.
*An indictment is merely an accusation. The defendant is presumed innocent unless and until proven guilty.
