AG STRANGE ANNOUNCES CONVICTION OF MAN IN ELMORE
COUNTY FOR FIRST-DEGREE RAPE OF A CHILD
(MONTGOMERY) – Attorney General Luther Strange announced the conviction
of an Elmore County man for first-degree rape of a child. Nicky Marsh, 37, pleaded
guilty in Elmore County Circuit Court the morning of January 23, on the day he was
scheduled to stand trial.
Marsh previously had been sentenced to 20 years in prison for sexual abuse of a
child under 12 years old by a Macon County Circuit Court judge after being tried by the
Attorney General’s Office on April 22, 2011. Marsh pleaded guilty on Monday to a
charge from an indictment on September of 2010, based on evidence presented to the
grand jury by the Attorney General’s Violent Crimes Division. The victim in both cases
is the same child.
According to the agreement under which he pleaded guilty in Elmore County,
the recommended sentence is 25 years. Marsh is scheduled to be formally sentenced on
February 28.
Attorney General Strange commended Assistant Attorneys General Kelly
Hawkins and Ben Baxley of his Violent Crimes Division, the special agents of his
Investigations Division, and Doris Hancock of his Victims Service Office. He also
thanked the Elmore County Sheriff’s Office, noting in particular Chris Ogden who
served as lead investigator for this case.
“The work done by our Violent Crimes Division involves heartbreaking cases
such as this one, of horrible crimes that devastate innocent lives,” said Attorney General
Strange. “It is important that these criminals are punished for their wrongdoing and
that victims receive a measure of justice for the pain they have suffered.”
