AG STRANGE ANNOUNCES 25-YEAR PRISON SENTENCE OF
ELMORE COUNTY MAN FOR FIRST-DEGREE RAPE OF A CHILD
(MONTGOMERY) – Attorney General Luther Strange announced that an Elmore
County man was sentenced today to 25 years in prison for first-degree rape of a child.
Nicky Marsh, 36, is to serve the entire 25 years in prison with no possibility of a reduced
sentence for “good time” or early release by parole. In addition, upon his release, he
will be subject to 10 years of stringent supervision with requirements for registration as
a sex offender, community notification, and GPS monitoring.
Marsh pleaded guilty in Elmore County Circuit Court on January 23, the day he
had been scheduled to stand trial. Marsh previously had been sentenced to 20 years in
prison for sexual abuse of a child under 12 years old by a Macon County Circuit Court
judge after being tried by the Attorney General’s Office on April 22, 2011. The victim in
both cases is the same child. The sentences for both convictions were ordered to run
concurrently.
Attorney General Strange commended Assistant Attorneys General Kelly
Hawkins and Ben Baxley of the Attorney General’s Violent Crimes Division, Special
Agents of the Investigations Division, and Doris Hancock of the Victims Service Office.
He also thanked the Elmore County Sheriff’s Office, noting in particular Chris Ogden
who served as lead investigator for this case.
“A long prison sentence is an appropriate punishment, but it can never undo the
great harm caused by Nicky Marsh,” said Attorney General Strange. “It is my hope that
this strong measure of justice may bring a degree of peace to his victim, and may serve
as a stern warning to others who might commit such terrible acts. The work done by
those in our Violent Crimes Division and our Victims Service Office involves
heartbreaking cases such as this one, of terrible crimes that devastate innocent lives. I
am proud of their determination and caring dedication.”
