AG ANNOUNCES THAT COURT OF CRIMINAL APPEALS
UPHOLDS LIMESTONE COUNTY MURDER CONVICTION
(MONTGOMERY) – Attorney General Luther Strange announced that the
Alabama Court of Criminal Appeals last Thursday upheld the murder conviction of
Kenny Dewayne Adams. Adams, 37, of Athens, was convicted in Limestone County
Circuit Court in August of 2014 for the murder of Yancy Foster.
Evidence presented at trial showed the following: On December 31, 2012, Adams
argued with the victim, Yancy Foster, who was his cousin. The argument was over an
alleged threat that Adams had made toward Foster’s seven-year-old son. Later that day,
Adams came to the Fosters’ home, ostensibly in search of a movie the victim’s son had
borrowed from him. After Adams entered the Foster home, he became engaged in a
scuffle with Foster, during which Foster tried to force Adams out of the home and
Adams stabbed him in the chest and neck. Adams then ran to his truck and drove
away, but was found later that evening and taken into custody. Foster died while being
treated by paramedics.
The case was prosecuted at trial by Limestone County District Attorney Brian
Jones’ office. Adams was sentenced to 30 years in prison and subsequently sought to
have his conviction reversed on appeal.
The Attorney General’s Criminal Appeals Division handled the case during the
appeals process, arguing for the Alabama Court of Criminal Appeals to affirm the
conviction. The Court did so in a decision issued on Thursday, July 2.
Attorney General Strange commended Assistant Attorney General John Porter of
the Attorney General’s Criminal Appeals Division for his successful work in this case.
