AG Steve Marshall Announces Court of Criminal Appeals
Upholds Tuscaloosa County Murder Conviction
(MONTGOMERY) Attorney General Steve Marshall announced that the
Alabama Court of Criminal Appeals upheld the murder conviction of Henry Patrick
McGhee, Jr. McGhee, 27, of Tuscaloosa was convicted in Tuscaloosa County Circuit
Court in December 2017 for the murder of Kevin Lynn Patrick. McGhee also was
convicted of first-degree theft.
Evidence at trial established that on April 19, 2015, during a fight, McGhee
choked Patrick until he no longer moved. Witnesses testified that McGhee got up and
walked away, then returned and kicked Patrick in the temple with tremendous force.
McGhee took money out of Patrick’s pockets and stated that he hoped that Patrick died.
Patrick’s cause of death was blunt force trauma to the head.
Tuscaloosa County District Attorney Hays Webb’s office prosecuted the case in
circuit court. McGhee was sentenced as a habitual offender to life imprisonment for the
murder conviction, and 20 years’ imprisonment for the first-degree theft of property
conviction. Prior to the murder, McGhee had recently been released from prison where
he had served two years of a split 10-year sentence for attempted murder of a
Tuscaloosa police officer. McGhee appealed his convictions for Patrick’s murder and the
theft.
The Attorney General’s Criminal Appeals Division represented the State during
McGhee’s appeal, urging the Court of Criminal Appeals to reject McGhee’s arguments
and to affirm the convictions. On August 24, 2018, that court affirmed McGhee’s’
convictions.
Attorney General Marshall commended Assistant Attorney General William Dill
of the Attorney General’s Criminal Appeals Division for his successful work in this
case.
