(Montgomery)—Attorney General Steve Marshall announced the Alabama Court of Criminal Appeals affirmed the conviction of Jermaine Curtis Boswell, 37, of Birmingham, for murder and attempted murder. Boswell was convicted in the Jefferson County Circuit Court – Bessemer Division on May 31, 2022.
The evidence at trial showed that on September 16, 2017, Fairfield police responded to the scene of an accident on Gary Avenue and found both a wrecked vehicle and the victim, Michael Stevens, who was deceased from a gunshot wound. The subsequent police investigation revealed that Boswell had gotten into an accident as a result of a game that the occupants of the other vehicle were playing with Boswell. The evidence at trial showed that Boswell had been in an altercation and resulting accident with the victim but, apparently, in a fit of rage, followed the victim’s vehicle and fired the fatal shots as an act of retribution.
Jefferson County – Bessemer Division – District Attorney Lynneice Washington’s office successfully prosecuted this case and obtained guilty verdicts. Boswell was sentenced to life imprisonment without the possibility of parole for his convictions. Boswell sought to have his convictions reversed on appeal.
The Attorney General’s Criminal Appeals Division handled the case during the appeals process, arguing for the Alabama Court of Criminal Appeals to affirm Boswell’s convictions. The Court did so in a decision issued Friday, August 11, 2023.
Attorney General Marshall commended Assistant Attorney General John E. Owen for his successful work on this case and thanked District Attorney Lynneice Washington and her staff for their valuable assistance in defending the robbery and attempted murder convictions.
